This Agreement is between You and Jersey Apartment & Realty Co., LLC ("Jersey Apartment Co.," "we" or "us").

The following terms and conditions (the "Terms and Conditions") apply to all visitors to or users of this Web site (the "Site"). By accessing this Site, the user acknowledges acceptance of these Terms and Conditions. In the case of any violation of these Terms and Conditions, Jersey Apartment Co., and its subsidiaries and affiliates, reserve the right to seek all remedies available by law and in equity for such violations. This Agreement may be amended at any time from time to time by us without specific notice to you. The latest Agreement will be posted on the Site, and you should review this Agreement prior to using the Site. Jersey Apartment Co., and/or its suppliers, reserve the right in its sole discretion to improve, modify or remove any information or content appearing on this Site. Jersey Apartment Co. may discontinue or revise any or all aspects of the Site in its sole discretion and without prior notice to you.

1. Copyright. This Site and the services provided on this Site are owned by Jersey Apartment Co. and/or its third party licensors. The content, information, organization, graphics, design, compilation, images, sounds, software, documents, products and services and other matters related to the Site (collectively, the "Information") are protected under applicable copyrights, trademarks and other proprietary (including but not limited to intellectual property) rights. The copying, redistribution, use or publication by you of any such Information or any part of the Site, except as expressly authorized herein, is strictly prohibited. You do not acquire ownership rights to any content, document or other materials viewed through the Site. The posting of information or materials on the Site does not constitute a waiver of any right in such Information and materials.
2. Trademarks. The trademarks, trade names and service marks (the "Marks") displayed on this Site are the property of Jersey Apartment Co. or other third parties. Users are not permitted to copy or otherwise use these Marks without the prior written consent of Jersey Apartment Co. and any such third party owner of the applicable Mark.
3. Limited Right to Use. The viewing, printing or downloading of any content, graphic, form or document from the Site grants you only a limited, nonexclusive license for use solely by you for your own personal use and not for republication, distribution, assignment, sublicense, sale, preparation of derivative works or other use. No part of any content, form or document may be reproduced in any form or incorporated into any information retrieval system, electronic or mechanical, other than for your personal use (but not for resale or redistribution). For instance, if you are a property owner or manager, you may only use the Information in connection with your use of the services expressly offered by Jersey Apartment Co and you may not modify or redistribute the Information in any way. Except as expressly provided above, nothing contained herein shall be construed as conferring, by implication, estoppel or otherwise, any license or right under any patent, trademark or copyright of Jersey Apartment Co. In addition to being subject to these Terms and Conditions, your use of the Information is also subject to the terms and conditions set forth in our Privacy Policy also found on this Site. Furthermore, you agree that you will not (a) use any automatic device or manual process, such as robot, spider or otherwise, to monitor or copy our Web pages or the content contained herein without our prior express written permission; (b) use any device, software or routine to interfere or attempt to interfere with the proper working of any Jersey Apartment Co. Sites or any listing, offer or transaction being conducted on our Sites; or (c) take any action that imposes an unreasonable or disproportionately large load on our infrastructure.
4. Compliance with Laws; Export Controls. At all times during the term hereof and subsequent to the termination hereof, you represent and warrant to Jersey Apartment Co. that you will comply with (1) these Terms and Conditions; and (2) all applicable laws, statutes, ordinances and regulations in any way relating to your use of our service, the Information and any related activities. In addition, you warrant that you will not use this Web site in any way prohibited by these terms, conditions and notices. You acknowledge that the software and any accompanying documentation and/or technical information is subject to applicable export control laws and regulations of the U.S.A. You agree not to export or re-export the software, directly or indirectly, to any countries that are subject to U.S. export restrictions.
5. Third-Party Web Sites. This Site may contain links to Websites operated by parties other than Jersey Apartment Co. These links are provided for reference only since Jersey Apartment Co. does not control such Web sites. Your use of such Websites shall be strictly at your own risk. Jersey Apartment Co. does not endorse any materials or content on any third parties Websites and shall not be responsible for the contents thereon.
6. General Disclaimer. Although Jersey Apartment Co. has attempted to provide accurate information on the Site, Jersey Apartment Co. assumes no responsibility for the accuracy of the information. All information provided on this Site is provided "as-is" with all faults and without warranty of any kind, either express or implied. Jersey Apartment Co. hereby disclaims all warranties, express or implied, including, without limitation, those of merchantability, fitness for a particular purpose, title and non-infringement or arising from a course of dealing, usage or trade practice, except to the extent such disclaimers are held to be legally invalid.
7. Limitation on Liability. Neither Jersey Apartment Co. nor any of its directors, employees, agents, vendors or suppliers will be liable for any direct, indirect, special, punitive, consequential or incidental damages including, without limitation, lost profits or revenues, costs of replacement goods, loss or damage to data arising out of the use or inability to use this Site or any Jersey Apartment Co. product or service, or damages from the use of or reliance on the information present on this Site, even if Jersey Apartment Co. has been advised of the possibility of such damages.
8. Severability. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect. Although Jersey Apartment Co. may be licensed as a Real Estate Broker in the State of New Jersey, it does not render legal, brokerage, or other professional advice or services to any of its customers, whether such customers are renters, lessors or otherwise.
9. Governing Law. This agreement is governed by the laws of the State of New Jersey, without regard to its conflicts of laws principles. You hereby consent to the exclusive jurisdiction and venue of courts in Gloucester County, New Jersey, in all disputes arising out of or relating to the use of this Site. Use of this Site is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation this paragraph.
10. Limitations on Services Provided. In addition to the other Terms and Conditions set forth above or elsewhere on this Site, in connection with your use of Jersey Apartment Co.'s Site and/or any services, you acknowledge and agree as follows: (a) unless expressly agreed in a separate written agreement with Jersey Apartment Co., Jersey Apartment Co. does not participate in any actual lease transactions, including, without limitation, negotiations, discussions, or proposals; (b) Jersey Apartment Co. does not render legal, brokerage, or other professional advice or services; (c) Jersey Apartment Co. shall not, and undertakes no fiduciary duties to any parties, to inspect rental properties or to verify the that any information obtained through the use of this Site or in any way related to services provided by us is accurate, true and/or correct; (d) Jersey Apartment Co. does not guarantee the accuracy of any information available on this Site, and is not responsible for any errors, omissions, or misrepresentations, whether made by renters, lessors or otherwise and all information obtained on this Site must be independently verified by you; and (e) Jersey Apartment Co. does not monitor transmissions of information by renters and lessors and thus assumes no liability for renters' and/or lessors' failures to comply with any state and federal civil rights laws.
